Why is the delivery date important?The landlord must ensure that the tenant has the benefit of the full notice period required under the lease. As such, the delivery of the notice must occur before any required notice period begins. Otherwise, the tenant will be able to say they did not receive valid notice and any further steps taken by the landlord, such as seeking termination of the lease, may not be enforceable.How can I deliver the notice to the tenant?Generally, legislation provides for in-person or postal delivery; however, it will depend on what is stated in the lease. Many current leases provide for electronic notice (by email) as well. Please consult your lease for the allowable methods for delivering your notice to the tenant.What is proof of service and do I need it?Depending on what is stated in your lease regarding delivery of documents, 'proof of service' (proof that your tenant received the notice) may or may not be required, and will depend on the method of notice that you provided.

For example, if you deliver the document in person, you might want to have an objective third party (a person who is unrelated to you and has no interest in the matter) witness the delivery, or if a third party is delivering the notice, you might want to have them prepare an affidavit of service. This will be beneficial in case the tenant later tries to deny having received the notice.

If your lease allows for it, and you deliver the notice by email, you may want to request a delivery receipt and/or a read receipt to be sent to you when the recipient receives and opens the email, respectively.

It is generally advisable to maintain some form of documentation to demonstrate that the notice was properly delivered to the tenant.

NOTICE TO: _____________________ (the "Tenant"), and all other persons in occupation

TAKE NOTICE THAT:

  1. Pursuant to a written lease agreement (the "Lease") dated 8 December 2025 you are obligated to pay certain rents on the premises described as: ________________________________________ (the "Premises"), of which you now hold possession.
  2. You are late in the payment of rents totaling __________. This rent was due on 8 December 2025.
  3. You are hereby required to PAY the said rents, in full, to the landlord or its agents by 8 December 2025 (the "Payment Date").
  4. If you fail to pay the above mentioned rent on or before the Payment Date, the landlord may begin a process for forfeiture of the Premises.

THIS NOTICE TO REMEDY BREACH OF COVENANT IS GIVEN PURSUANT TO THE APPLICABLE LAWS OF THE AUSTRALIAN CAPITAL TERRITORY AND IN NO WAY IMPAIRS OR LIMITS ANY OF THE OTHER REMEDIES OR RIGHTS THAT THE LANDLORD MAY HAVE UNDER THE LEASE AGREEMENT OR UNDER THE SAID LAWS.
