BACKGROUND:

  1. The Artist may choose or is currently engaged in the business of creating media, which includes but is not limited to engaging in the following activities for personal and commercial gain:
    • photography, photo editing, and photo production; digital photography, digital photo editing, and digital photo production; and web design and production.
  2. The Model consents to being a subject of the Artist in media. The Model will allow the Artist to capture images and sound recordings for use in media.  

WHEREBY:

THE ARTIST IS RELEASED OF LIABILITY: For good and valuable consideration herein acknowledged as received, the Model releases the Artist and assigns permission to license all images and sound recordings and to use of images and sound recordings in any media for any purpose which may include, among others, advertising, promotion, marketing and packaging for any product or service. The Model agrees that any images and sound recordings may be combined with other images, text and graphics, cropped, altered and modified.

THE ARTIST RETAINS ALL RIGHTS: The Model agrees that the Artist has all rights to images and sound recordings, for perpetuity unless explicitly noted in this Agreement. The Model acknowledges and agrees that the Artist is not liable for any further consideration, accounting, or claim for any reason.

DURATION OF AGREEMENT: The Model acknowledges and agrees that this Agreement is binding on all heirs and assigns. The Model acknowledges and agrees that this Agreement is irrevocable, worldwide and perpetual.

This Agreement contains the entire agreement between the parties to this release and the terms of this Agreement are contractual and not a mere recital.

This Agreement will be construed in accordance with and governed by the laws of the Province of Alberta.

What is a Model and Entertainment Release?

A Model and Entertainment Release form is used by photographers or videographers to get permission from models to license or publish their photo for commercial usage.

What is commercial use?

Commercial use of a photograph means that it will be used for advertising purposes, such as to promote a product or service. For example, if a photographer takes a photo of a model wearing jewelry that is going to be published in a magazine as an advertisement for a jewelry company, it is considered to be commercial usage.

Editorial use is not to be confused with commercial use. It means used for the purpose of news, such as newspaper stories, online news articles, or television interviews. Any image that is an accurate depiction of events or facts is considered editorial usage, such as a photo taken of a local business owner to be published in a newspaper about the grand opening of their business. Photos taken for editorial usage do not require a Model Waiver.

When is a Model Release required?

A Model Release is required when photographers intend to publish or license photos of models in print, online, television, or radio advertisements where the model's likeness is identifiable and he or she is portrayed as promoting a product or service (e.g. a model wearing a shirt with a business logo on it).

What is a "model's likeness"?

A model's likeness can include anything that identifies them as a person, including:

  • Face or silhouette
  • Identifiable marks, such as tattoos or birthmarks
  • Voice
  • Signature
  • Clothing or uniform
  • Circumstances, such as location, context, or action

Why should I use a Model and Entertainment Release?

A Model Waiver protects both the model and the photographer. It establishes clear expectations about how the photo will be used and provides proof that the terms of the release were agreed to by both parties.

Because the model acknowledges the use of their likeness in the agreement, the photographer can then license or publish the photo in accordance to the release. This can lower the chances of any future misunderstandings regarding rights of privacy.

Do I need a release for photos that are taken in public?

Typically, photos that are shot on public property do not require a release, unless that photo is going to be used for an endorsement.

What kinds of model releases are there?

There are a few different types of Model and Entertainment Releases, including:

  • Adult Release: general model release for those who are 18 or older
  • Minor Release: a release form for those who are under 18 years old, requiring a signature from a parent or legal guardian
  • Pocket Size Release: a short pocket-sized model release form
