Instructions on creating your Last Will and Testament

  1. Complete the answers on this page. You will only have to answer those questions that are needed based on your prior answers. If you have any questions as to possible answers for a question, simply hold your mouse over the Hint and you will see an explanation of that term or other information.

  3. Print your Last Will and Testament.
  4. Sign your Will. You MUST have two witnesses present and watching while you and the other witness sign your Will. You and the two witnesses should then initial the bottom right hand corner of each page of the Will. The witnesses do NOT need to be lawyers and do not need to read your Will. A witness should be an adult who is not receiving a gift in your Will and is not married to a person receiving a gift in your Will.
  5. Store your Will in a safe place. Let someone you trust know where your Will is stored.

You MUST have two witnesses present and watching you while you execute your Last Will and Testament. Each Witness must sign as a witness in your presence and in the presence of the other witness. 'In your presence' means actually watching them. You and the two witnesses should then initial the bottom right hand corner of each page of the will (except the page signed by all three of you). The witnesses do NOT have to be lawyers. Witnesses should NOT be individuals who will be receiving gifts in your will or the spouses of individuals receiving gifts in your will. 1. You might want to consider having an affidavit of execution sworn by one of the witnesses in front of a notary public. An affidavit of execution provides evidence as to the proper execution of your Last Will and Testament. 2. Affidavit of Execution
